Standard Terms and Conditions of Booking
1. General Booking Terms and Conditions:
1.1. The following Booking Terms and Conditions apply to the booking of any [twenty3 extreme’s full legal name] (“twenty3 extreme”) activity as set out in the booking confirmation.
1.2. These Booking Terms and Conditions contain important information concerning participation by you and all members of your party (collectively, the “Participants”) and accordingly, by booking, you acknowledge and agree that you shall ensure that all Participants are aware of and accept these Booking Terms and Conditions. No variation to these Booking Terms and Conditions shall be binding unless agreed in writing by twenty3 extreme.
1.3. twenty3 extreme reserves the right to make changes to the activities where necessary to conform with any applicable safety or other statutory requirements or otherwise.
1.4. All Participants, observers and their guests are required to act responsibly and courteously at all times and to respect all twenty3 extreme staff and other Participants and participants. twenty3 extreme shall be entitled to prevent any person from undertaking or completing the activities in the event that it deems their behaviour unsuitable. No refund will be payable in such circumstances.
1.5. twenty3 extreme will not be responsible for any damage to or loss of clothing or personal items resulting from participation in the activities.
1.6. By booking the Participants accept the inherent risks associated with adventurous activities, and whilst we make every reasonable effort to minimise the risk of injury on our activities, we advise all Participants to obtain personal injury insurance.
1.7. Any Participant under the age of 18 years must have the explicit permission of his/her parent or legal guardian before being able to take part in any activity offered by twenty3 extreme. The parent or guardian needs to be aware and accept the risks involved in adventure sports and satisfy themselves accordingly.
2. Booking Confirmation:
2.1. No booking shall be deemed to have been accepted unless done so in writing (which includes email) by twenty3 extreme.
3. Cancellation and changes by the customer/Participant:
3.1. Participants may cancel their booking by notifying twenty3 extreme or their booking agent, where applicable, in writing. The applicable cancellation fees shall be determined with reference to the date on which the request to cancel is received by twenty3 extreme and are expressed hereinafter as a percentage of the total price paid for the cancelled product.
3.2. For individual customers: (a) Cancellation received 22 days or more before departure of first Product to depart in relevant booking: 100% of the Product total shall be refunded to the Participants. (b) Cancellation received 21-8 days before departure of first Product to depart in relevant booking: an amount equal to 50% of the total Product shall be refunded to the Participants. (c) Cancellation less than 7 days before departure of first Product to depart in relevant booking: no refund shall be payable to the Participants.
3.3. For group bookings and/or multi-day tours (more than 2 days): (a) Cancellation received 61 days or more before departure of first Product to depart in relevant booking: 100% of the Product total price shall be refunded to the Participants. (b) Cancellation received 60-31 days before departure of first Product to depart in relevant booking: an amount equal to 50% of the total Product shall be refunded to the Participants. (c) Cancellation less than 30 days before departure of first Product to depart in relevant booking: no refund shall be payable to the Participants.
3.4. Refunds may only be requested within 48 hours of the booking being made, and will be subject to the deduction of an admin fee. If bookings are made within 48hrs of the activity date no refunds can be requested.
3.5. Should there be last minute additions to your booking twenty3 extreme will always attempt to accommodate them (additional fees will apply), although increases cannot always be accepted at short notice due to staffing ratios and equipment availability.
4. Cancellation and changes by twenty3 extreme:
4.1. If a tour is cancelled by twenty3 extreme before the agreed date of departure for reasons not arising from the fault or negligence of or within the reasonable control of the Participants, the Participants shall have the choice of:
4.2. accepting from twenty3 extreme a substitute tour product of equivalent or superior value, where such substitute is reasonably available; or
4.3. accepting from twenty3 extreme a substitute tour of lower value if no tour of equivalent or superior value is reasonably available, and to recover from twenty3 extreme the difference in price between the price of the tour originally purchased and that of the substitute tour; or
4.4. accept from twenty3 extreme a full refund of all monies paid for the cancelled product(s).
4.5. twenty3 extreme is not responsible for any incidental expenses or consequential losses that the Participants may have incurred as a result of the cancelled booking such as visas, vaccinations, non-refundable flights or rail, non-refundable car parking or other fees, loss of earnings, or loss of enjoyment, etc. twenty3 extreme reserves the right to issue a full refund in lieu of the choices above, at its sole discretion. Where after departure a significant element of the product(s) as described cannot be provided, twenty3 extreme will make suitable alternative arrangements for the continuation of the product(s). If it is not possible to provide a suitable alternative or the Participants reasonably reject any suitable alternatives, twenty3 extreme will provide the Participants a refund of unused products or product portions.
4.6. The Participant must advise twenty3 extreme within 48 hours of any mistake in your activities booking confirmation.
4.7. twenty3 extreme shall take all reasonable steps to ensure that the Participants’ participation commences at the time booked and it shall be the responsibility of the Participants to ensure they arrive in sufficient time. Late arrivals may not be permitted to undertake the activities and no refunds or compensation will be payable in such circumstances.
4.8. If any Participant fails to attend or to participate for any reason, any monies paid are non-refundable.
4.9. If any Participant changes their mind once safety equipment has been fitted and/or the activity has commenced or fails to complete the activity for any reason no refund will be available.
4.10. Any typographical, clerical or other error or omission in any booking confirmation or other documentation (including electronic documentation) issued by twenty3 extreme shall be subject to correction without any liability on their part.
4.11. Only twenty3 extreme shall be entitled to postpone or amend a session for any reason once a booking has been made.
4.12. twenty3 extreme shall take all reasonable steps to provide the activities agreed upon booking, however it must be remembered that we operate in a dynamic outdoor environment and twenty3 extreme may be required to make amendments at short notice in order to ensure the safety and enjoyment of Participants and staff.
4.13. In the event that twenty3 extreme are required to postpone a session, and any bookings made for that session, due to unsuitable weather or sea conditions that would affect the safety and enjoyment of the session, twenty3 extreme shall take all reasonable steps to notify Participants as soon as possible.
4.14. In the rare instances that it may be necessary, twenty3 extreme reserves the right to cancel any activity where weather conditions or sea state prevents safe participation or where insufficient bookings or participant cancellation make the activity unworkable.
4.15. In the rare instance that twenty3 extreme may need to cancel a booked session, twenty3 extreme will always offer;
4.16. An alternative activity, whenever possible (should the Participant wish to take up the offer of a transfer, any difference in cost will be charged or credited accordingly).
4.17. To rebook the session for an alternative date.
4.18. A gift voucher for the cost of the activity, which is valid for one year.
5. Group and Party bookings (Including Schools, Youth Groups, Corporate Groups & Course Bookings; Event safety, fixer and media production):
5.1. A non-refundable deposit of 50% of the total booking value is due at the time of booking, the balance is due no later than 14 days prior to the activity date, if not otherwise agreed between us in writing.
5.2. Failure to pay the balance payment 14 days prior to the activity date will result in late payment charges and could result in your booking being cancelled – upon which no monies paid will be refunded.
5.3. Subject to any terms agreed in writing between twenty3 extreme and the Participant, our charges shall be calculated at our current rates.
5.4. Should you be collecting participation fees from individuals we would recommend you do so in advance, as the party leader will be liable for full payment of any balance due.
6. Personal Property and Liabilities:
6.1. twenty3 extreme shall not be responsible for the loss off or damage to any personal property or person arising from the booking or participation in the activities. It is suggested that all the Participant’s property be secured by them in an appropriate location. If a Participants requests twenty3 extreme to look after any property then twenty3 extreme cannot guarantee its security and no responsibility will be taken for loss or damage. Property belonging to the customer is at all times the responsibility of the customer.
6.2. twenty3 extreme does not have it’s own private car parks at any of its locations. Customers leave their vehicles at their own risk and it is their responsibility to adhere to parking regulations and pay any charges where applicable in public car parks.
6.3. No responsibility can be taken by twenty3 extreme for travel or accommodation costs incurred by Participants where a session is postponed at late notice.
6.4. twenty3 extreme reserve the right to refuse participation to Participants if we believe them to be under the influence of alcohol and/or drugs. No refund will be provided in this instance.
7. Acknowledgement of Risk:
7.1. Participation in adventurous activities involves some inherent risks and whilst twenty3 extreme, their staff and agents are appropriately qualified, experienced and licensed by relevant bodies and constantly work to limit the risk of these activities, participants must acknowledge these risks and take steps to act in their own best interests.
7.2. Whilst we make every effort to minimise the risk of injury on our activities, we advise all participants to take out personal injury insurance.
7.3. All bookings are on the basis that the Participant will, at all times, observe the safety regulations and follow the safety instructions of twenty3 extreme and it’s staff.
7.4. Any customer under the age of 18 years must have the explicit permission of his/her parent or legal guardian before being able to take part in any activity offered by twenty3 extreme. The parent or guardian need to be aware and accept the risks involved in adventure sports and satisfy themselves accordingly.
7.5. All participants are required to sign (physically or by digital signature) a consent form indicating that they understand and accept that there are inherent risks and that they have disclosed any medical conditions that may, in any way, have any bearing on their ability to take part in adventure activities.
7.6. General Recreation Participants and Children’s Parties: all participants or, if under 18 years, a parent/guardian, will be required to agree (by physical or digital signature) to twenty3 extreme’s Waiver that he/she is aware of the activity requirements and associated risks.
7.7. Schools & Youth groups: The organiser must have twenty3 extreme Waiver signed by a parent/guardian for each child under 18 years stating that they are aware of the activity requirements and to confirm visiting teaching staff, leaders, parents and carers retain overall responsibility for all children in their care. It is understood and agreed that the organiser (such as school, etc.) will be considered as the guardians of the Participants that are under 18 years of age, or otherwise may need additional attention or supervision.
7.8. Corporate Groups & Off-Site hire: The Organiser shall ensure that each Participant signs the twenty3 extreme Waiver stating that he/she are aware of the activity requirements and risks.
8. Safety and Activity requirements:
8.1. All Participants will receive a safety briefing and instruction from a staff member prior to the beginning of an activity, these must be adhered to at all times.
8.2. Due to the nature of adventurous activities all participants should be reasonably fit and healthy. The activities may be physically and mentally demanding and require varying degrees of agility, strength and stamina. If participants have medical concerns, they are advised to consult their own doctor in advance. All Participants/Participants must certify that they do not have a medical condition which might be unsuitable for participating in an activity with twenty3 extreme or which might increase the chance of the Participant being involved in an accident or incident, resulting in injury to themselves or others including but not limited to; heart condition, epilepsy, back, shoulder, neck or joint problems. Participants with such conditions may participate at their own risk.
8.3. Some activities may have specific requirements (i.e., swimming ability, age, weight restrictions) anyone who does not meet these requirements will not be allowed to participate in the chosen activity and it is the booker’s responsibility to ensure that all members of your party meet these requirements when booking.
8.4. twenty3 extreme reserves the right to refuse admittance to the activities or to prevent any person from undertaking or completing the activities in the event that it deems they are not capable to proceed or may be putting the safety of others at risk. This includes anyone who does not comply with the safety rules or advice, who misuses twenty3 extreme equipment and safety systems or who is deemed under the influence of alcohol or drugs. No refunds or compensation will be payable in such circumstances.
8.5. All participants must be confirmed capable to proceed to the next level of any activity by a twenty3 extreme Instructor and the Instructor’s decision on the day is final.
8.6. All Participants are required to wear any necessary safety equipment provided by twenty3 extreme and fitted by an instructor in order to participate. Removal or failure to correctly wear the given safety equipment may result in exclusion from the activity.
8.7. Due to the physical nature of the activities, twenty3 extreme recommends that pregnant women seek medical advice prior to taking part in activities and do so at their own risk.
8.8. twenty3 extreme will always make adjustments as is within our control to enable Participantss with disabilities to take part in activities. Please get in contact with us prior to booking/your activity in order to discuss how we can look to accommodate your disability.
8.9. No refunds or compensation will be payable should the Participants decide not to participate or complete any of the activities for any reason.
9.1. twenty3 extreme may often take photos and/or videos on our activities. These photos and videos may be used for both online and offline advertising purposes by twenty3 extreme.
9.2. The photos are stored on a private server and are available for inspection at any time by anyone who makes a genuine and credible request.
9.3. If you have any concerns or do not wish to be included in any photos please make it clear to your activity leader in writing before activity commencement.
10. Issues & Complaints
10.1. twenty3 extreme prides itself on the quality of its service. If you feel that the quality of your experience did not match the expectations, or where problems on the activity may have been encountered. We ask you to undertake the following:
10.2. You must call in to a booking office, or speak to an activity guide immediately following an activity or course.
10.3. You must be able to articulate and provide detail as to why you believe there is cause for complaint. We ask you to put this in writing and either mail to: [address] Or email us at: [ID]
10.4. All communication will be reviewed by the Operations Manager, where the situation will be investigated thoroughly.
10.5. Refunds may be offered at management’s discretions only and after full investigation. Any refunds made will only be from the cost payable to twenty3 extreme, no other expenses or compensation will be recoverable.
10.6. The Participant hereby expressly waives off any right to claim a compensation or costs or any other monies from twenty3 extreme for any reasons whatsoever except than those expressly provided herein and to the limit of the cost payable to twenty3 extreme by the Participant.
11. Errors, omissions or amendments:
11.1. twenty3 extreme endeavours to keep to all published prices and other information up to date but reserve the right to alter them at any time. You will be advised of any price amendments or other relevant changes made after the booking is processed and will be given the opportunity then to cancel or make amendments as necessary.
12.1. Any disputes arising out of or in connection with an activity taken with twenty3 extreme shall be settled through the relevant courts in Muscat, which shall have the exclusive jurisdiction over any claims connected hereto.
